All About K-1 Fiancee Visa Requirements And Eligibility

Introduction

The K-1 is a nonimmigrant classification that is designed to facilitate the admission of intending immigrants who wish to marry. The K-1 visa allows the fiancé(e) of a U.S. citizen to enter the United States for a 90-day period to marry the U.S. citizen petitioner and apply for permanent residence. The foreign national fiancé(e) may be able to obtain temporary permission to work when he or she arrives in the U.S..

Requirements For K-1 Visa

A. Who May Apply For A K-1 Visa?

A foreign national is eligible to apply for a K-1 fiancé(e) visa if:

1. the fiancé(e) is a U.S. citizen

2. he or she is engaged to be married to the U.S. citizen fiancé(e)

3. the couple have met in-person within the last 2 years

Exceptions to the Requirement of Meeting In-person: There are two exceptions to the requirement of meeting in-person:

a. Long-established religious customs: If the requirement to meet the U.S. citizen fiancé(e) in person would violate strict and long-established customs of the U.S. citizen’s or the foreign national fiancé(e)’s cultural or social practice.

b. Extreme hardship: If the U.S. citizen proves that the requirement to personally meet the fiancé(e) would result in extreme hardship to the U.S. citizen.

TIP: These are very difficult standards to meet.

4. the couple is legally eligible to marry under the laws of their own country as well as the laws of the U.S.

5. the foreign national’s sole intention for coming to the U.S. is to marry their U.S. citizen fiancé(e) and

6. the foreign national fiancé(e) and U.S. citizen petitioner plan to get married within 90 days of the foreign fiancé(e) entering the U.S.


B. Ineligibility To Apply For K-1 Visa

There are certain conditions and activities that may make a foreign fiancé(e) ineligible for a visa. Examples of these ineligibilities are:

  1. drug trafficking and related activities
  2. overstaying a previous visa
  3. practicing polygamy
  4. advocating the overthrow of the government and/or
  5. submitting fraudulent documents

NOTE: The consular officer is required to tell the foreign national fiancé(e) whether or not he or she is eligible for the visa, whether there is a waiver of the ineligibility available, if necessary and what the waiver procedure is.
